These Terms & Conditions ("Terms") govern your access to and use of the BidSense mobile application and related website (the "Service") operated by BidSense ("we", "us", or "our"). Please read them carefully. By accessing or using the Service you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, downloading, or using the Service you accept and agree to these Terms and our Privacy Policy (available here). If you do not agree, do not use the Service.
2. Changes to the Terms
We may update these Terms from time to time. If we make material changes we will provide notice (for example in the app or via email). Continued use of the Service after changes indicates acceptance of the revised Terms.
3. Eligibility
You must be at least 16 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet the eligibility requirements.
4. Accounts and Security
To use certain features you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
5. Services and Subscriptions
BidSense offers free features and optional paid subscriptions for additional functionality. Subscription purchases are processed via our payment partner (RevenueCat). By purchasing a subscription you agree to the terms presented during checkout and to any renewal and cancellation rules shown there.
Billing and refunds: Fees, recurring billing, and refund policies are described at checkout. If you have billing questions contact support@bidsense.nl.
6. User Content
You retain all ownership rights to content you provide (e.g., listing URLs, notes, uploaded images). By submitting content, you grant BidSense a worldwide, non-exclusive, royalty-free, transferable license to host, store, use, reproduce, modify, and display that content as needed to provide the Service and improve features.
You agree not to submit content that violates applicable law or third-party rights. We may remove content that violates these Terms or is otherwise objectionable.
7. Acceptable Use
You will not use the Service for unlawful purposes or to transmit malicious code. Prohibited conduct includes attempting to reverse engineer the Service, interfering with other users, scraping or bulk exporting data, or bypassing access controls.
8. Third-Party Services
The Service integrates with third-party providers such as Firebase and RevenueCat. Your use of third-party services is also subject to their terms and privacy policies. We are not responsible for third-party services or their practices.
9. Intellectual Property
All intellectual property rights in the Service (excluding user content) are owned by BidSense or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
10. Warranties and Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. The analyses, suggestions, and other outputs are for informational purposes only and do not constitute legal, financial or professional advice. You should independently verify results before acting on them.
11. Limitation of Liability
To the maximum extent permitted by law, BidSense and its affiliates shall not be liable for indirect, incidental, special, consequential, exemplary damages, or loss of profits, data, use, goodwill, or other intangible losses arising out of or related to your use of the Service. Our aggregate liability for direct damages will not exceed the amount you paid to BidSense in the 12 months preceding the claim (or €100 if you have not paid for the Service).
12. Indemnification
You agree to indemnify and hold BidSense harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.
13. Termination
We may suspend or terminate your access for violation of these Terms or for any lawful reason, with or without notice. On termination, your rights to access the Service cease. We may retain certain data as required for legal compliance or legitimate business purposes.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the country in which the data controller is established. If you are located in the European Union, you may bring claims before the courts of your member state. For consumers in the EU, mandatory local consumer protection laws apply.
15. Changes to the Service
We may modify, update, or discontinue features of the Service at any time. We will try to notify you of material changes where appropriate.
16. Miscellaneous
These Terms, together with the Privacy Policy and any other legal notices published by BidSense, constitute the entire agreement between you and BidSense regarding the Service. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
